Intellectual Property Attorney & Licensed Professional Engineer
Mr. Mochinski primarily focuses on preparing domestic and international patent and trademark applications. His experience also includes the licensing of intellectual property rights (patents, copyrights, trademarks, and trade secrets), as well as patent prosecution, primarily in the technological arts of chemical transport and metal recovery processes, gaming and vending systems operating under software control, electro-mechanical devices, nutritional products and supplements, medical devices, and construction and machinist tools and implements. In addition, he prepares infringement/validity and patentability opinions, freedom-to-operate analyses, and due diligence reviews and occasionally serves as a legal advisor and expert witness in court proceedings and hearings involving intellectual property matters.
While attending law school, Mr. Mochinski worked as a technical advisor/law clerk for a prominent law firm based in Michigan, where he drafted and prosecuted domestic and international patent applications and counseled technical members and staff of a major university in diversified areas of intellectual property, including the management and evaluation of patent assets derived from university-sponsored research and directed to economic redevelopment of local and state economies.
Prior to entering the practice of law, Mr. Mochinski was a process/chemical engineer for over 10 years working primarily in the areas of remediating and restoring hazardous waste sites under Superfund authority (CERCLA), in addition to managing and handling hazardous waste streams to ensure compliant disposal and handling under RCRA and evaluating and analyzing industrial waste streams for waste minimization opportunities. He has also been an invited speaker at numerous symposiums and conferences focusing on wastewater treatment processes and waste minimization techniques applied in the petrochemical and railroad industries. As a result of acquiring extensive engineering experience, Mr. Mochinski qualified for state licensure as a professional chemical engineer. Mr. Mochinski continues to hold his license as a professional engineer in the state of Minnesota concurrently with his standing as a licensed attorney in the state of Minnesota and as a registered practitioner in matters before the United States Patent and Trademark Office. Mr. Mochinski is also an admitted attorney of the United States District Court for the District of Minnesota and United States Court of Appeals.
